1. Acceptance of these terms
By accessing, registering with or using NatterFly, you agree to these Terms and Conditions. You should not use the website if you do not agree to them.
2. Member accounts
You must be at least 18 years of age to create or use a NatterFly account. If we reasonably believe that an account belongs to someone under the age of 18, we will suspend or permanently remove the account without notice.
You must not share accounts, access another person's account without permission or attempt to bypass website security.
3. Usernames and profiles
Usernames and profile information must not impersonate another person, business, organisation, moderator, administrator or member of NatterFly staff.
Reserved names, misleading names or names considered offensive may be changed or removed.
4. Community behaviour
Members must treat other people with reasonable respect. Friendly discussion and differences of opinion are welcome, but abusive or disruptive behaviour is not.
5. Prohibited conduct
You must not use NatterFly to:
- Harass, threaten, bully or intimidate another person.
- Post hateful or discriminatory content.
- Share illegal, fraudulent or harmful material.
- Post spam or repeatedly advertise without permission.
- Distribute malware, viruses or malicious links.
- Attempt to gain unauthorised access to accounts or systems.
- Share another person's private information without permission.
- Impersonate another person or organisation.
- Encourage dangerous or unlawful activity.
- Disrupt chatrooms or deliberately interfere with the website.
6. Chatrooms
Members may create chatrooms for communities, interests, hobbies, locations, radio stations or groups, subject to these terms.
Room owners are responsible for helping to keep their rooms welcoming and appropriately managed. Ownership of a room does not remove NatterFly's right to moderate, rename, restrict, transfer, close or delete it.
7. Chatrooms and Messaging
NatterFly does not provide private messaging through chatrooms, whispers or hidden one-to-one chat. Conversations within chatrooms may be visible to other users who have access to that room.
NatterFly provides a separate text-only Messaging Centre. Members can exchange messages only after a connection request has been accepted by both parties. Connection requests can be disabled, connections can be ended, and members can block unwanted contact.
Public chatroom conversations are recorded in secure server logs to help protect the community, investigate reports of abuse, review moderation decisions, safeguard users and comply with legal obligations where applicable.
Chatroom logs are only accessible to authorised NatterFly staff and are not publicly available.
Restricted or password-protected rooms provide controlled access but should not be treated as completely confidential. NatterFly reserves the right to review room activity where reasonably necessary for moderation, security, safeguarding or technical support.
8. Groups
Members may create or join groups based on shared interests, hobbies, locations, radio stations or communities, subject to these terms and the Community Rules.
Group owners and managers are responsible for helping to keep their groups appropriately managed. They may approve members, manage invitations, create discussions, polls, events and albums, and remove content or members from their group where reasonably necessary.
Group rules must not conflict with NatterFly's site-wide rules. Ownership or management of a group does not remove NatterFly's right to review, restrict, rename, transfer, close or delete the group or its content.
Public group content may be viewed by visitors or other members. Private or restricted groups provide controlled access but should not be treated as completely confidential.
9. Submitted content
You remain responsible for anything you post or upload, including messages, profile information, room and group descriptions, group discussions, replies, polls, events, albums, photographs, radio stations, images, links, scripts and downloadable files.
By posting content in a group, you understand that it may be viewed, discussed or moderated by people who have access to that group. Group owners and managers may remove content that breaches group rules or NatterFly's site-wide rules.
You must have permission or appropriate rights to share submitted content.
10. Scripts and downloads
Scripts and downloadable files are provided by their respective contributors. Members should check files before installing or using them.
NatterFly cannot guarantee that contributed scripts are suitable, secure, compatible or free from errors.
11. Radio stations and external streams
Radio station listings and streams may be operated by third parties. NatterFly does not control their programming, availability, licensing, privacy practices or external websites.
Station owners are responsible for ensuring that they have the appropriate rights and permissions to operate and promote their stations.
12. Moderation
NatterFly administrators and moderators may investigate reports and may edit, hide, lock, move or remove chatroom, group, event, poll, album or other community content where reasonably necessary.
Moderation decisions may take account of chat transcripts, context, severity, previous behaviour and the safety of the wider community.
Where appropriate, information may be preserved and disclosed to law enforcement or other competent authorities where required by law or where reasonably necessary to protect users or investigate suspected criminal activity.
13. Suspension and termination
Accounts may be warned, restricted, suspended or permanently banned where these terms are breached or where an account poses a risk to the website or community.
Serious conduct may result in immediate action without a prior warning.
14. Reporting concerns
Members should report abusive, illegal, unsafe or suspicious activity to NatterFly rather than escalating disputes in public chatrooms.
15. External links
NatterFly may contain links to third-party websites. These links are provided for convenience and do not represent an endorsement.
NatterFly is not responsible for external websites, purchases, services, downloads or communications.
16. Website availability
We aim to keep NatterFly available and working correctly, but uninterrupted access cannot be guaranteed.
Features may be changed, suspended or removed for maintenance, development, security or operational reasons.
17. Disclaimer
NatterFly is provided on an "as available" basis. Community content represents the views of individual contributors and does not necessarily represent the views of NatterFly.
You are responsible for deciding whether information, links, files or advice shared by other users is suitable for you.
18. Limitation of liability
To the fullest extent permitted by law, NatterFly will not be responsible for indirect loss, loss of data, loss caused by third-party content, or loss resulting from unavailable website features.
Nothing in these terms excludes liability where exclusion would be unlawful.
19. Privacy
Personal information, including the collection and retention of public chatroom transcripts, is handled in accordance with the NatterFly Privacy Policy.
20. Changes to these terms
These terms may be updated when the website, community features or legal requirements change. Continued use of NatterFly after an update means that you accept the revised terms.
